Igsby Terms of Use

1. Acceptance of Terms

By accessing or using the Igsby platform ("Platform"), including its community management features, social feed, directory, membership tools, and any related services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Igsby LLC ("Igsby," "we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to create an account, subscribe to the Services, or use the Platform in any capacity. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. Igsby requires users to confirm their date of birth during account creation and may use additional verification methods, including payment card authentication, to confirm eligibility.

Igsby does not knowingly collect personal information from individuals under the age of 18. If Igsby discovers or is notified that a user is under 18, we will immediately terminate the account and delete all associated personal data. Content posted by the underage user will be removed or anonymized within 30 days, consistent with the data deletion procedures described in Section 11. Any subscription fees paid on behalf of an underage user will not be refunded.

If you have reason to believe that a person under 18 has created an account or is using the Platform, please report it immediately to Igsby's Trust & Safety team using the contact information provided in Section 20.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Promptly update your account information if it changes
  • Notify us immediately of any unauthorized access to or use of your account
  • Not share, transfer, or sell your account to any other person

4. Community Manager and Site Administrator Responsibilities

4.1 Role of the Community Manager

A Community Manager (also referred to as a "Site Administrator" or "Site Manager") is the individual or entity that creates, operates, and manages a community on the Igsby Platform. Community Managers may subscribe to the Platform on behalf of their organization, import members into their community, and manage billing and membership outside of the Platform's standard user registration flow. By creating or managing a community on Igsby, the Community Manager agrees to the additional responsibilities set forth in this section.

4.2 Member Eligibility and Age Compliance

Community Managers are solely responsible for ensuring that all members they invite, import, or otherwise grant access to their community meet the Platform's eligibility requirements, including the minimum age requirement of 18 years as set forth in Section 2. This obligation applies regardless of how members are added to the community, including but not limited to:

  • Members imported via bulk upload, CSV, API integration, or any other batch onboarding method
  • Members invited via email invitation, referral link, or access code
  • Members whose subscriptions or fees are paid by the Community Manager or a third party rather than by the member directly through the Platform
  • Members who are granted access through any mechanism that bypasses the Platform's standard registration and age verification flow

By importing or inviting members, the Community Manager represents and warrants that each such member is at least 18 years of age. If any imported or invited member is discovered to be under 18, the member's account will be immediately terminated in accordance with Section 2, and the Community Manager may be subject to enforcement actions as described in Section 8, including suspension of the Community Manager's account or community.

4.3 Terms Acceptance for Imported Members

Community Managers acknowledge that all members who access the Platform, regardless of how they were added, are bound by these Terms. When importing members who have not completed the Platform's standard registration process, the Community Manager agrees to:

  • Ensure that each imported member is provided with a copy of or access to these Terms of Use and the Platform's Privacy Policy prior to or upon their first access to the Platform
  • Obtain each imported member's affirmative acknowledgment that they agree to be bound by these Terms, either through a mechanism provided by Igsby (such as a first-login acceptance prompt) or through the Community Manager's own onboarding process
  • Maintain records of such acknowledgment for the duration of the member's participation in the community and make such records available to Igsby upon request

If an imported member has not accepted these Terms through either the Platform's first-login acceptance mechanism or a documented alternative process administered by the Community Manager, Igsby reserves the right to restrict or terminate that member's access until acceptance is confirmed.

4.4 Off-Platform Payments and Billing

Where a Community Manager collects membership fees or subscription payments outside of the Platform (including but not limited to invoicing, bank transfers, third-party payment processors, or cash), the Community Manager acknowledges that:

  • The payment transaction between the Community Manager and their members is a separate contractual relationship to which Igsby is not a party
  • Igsby bears no responsibility for disputes, refunds, chargebacks, or billing issues arising from off-platform payment arrangements
  • The absence of a direct payment relationship between a member and Igsby does not exempt the member from any provision of these Terms
  • The Community Manager is responsible for any applicable tax collection and reporting obligations related to off-platform payments

4.5 Community Manager Indemnification

In addition to the general indemnification obligations set forth in Section 15, Community Managers agree to indemnify, defend, and hold harmless Igsby from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) any imported member's use of the Platform; (b) any imported member's failure to meet the Platform's eligibility requirements; (c) any failure by the Community Manager to ensure that imported members have accepted these Terms; or (d) any disputes arising from off-platform payment arrangements between the Community Manager and their members.

5. Prohibited Content and Conduct

Igsby is committed to maintaining a safe, inclusive, and respectful environment for all users. The following content and conduct are strictly prohibited on the Platform, including but not limited to the social feed, comments, community spaces, profiles, directories, and any other user-generated content areas:

5.1 Hate Speech and Discrimination

Users may not promote, glorify, or incite hatred, violence, or discrimination against any individual or group based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, veteran status, or any other protected characteristic. This includes:

  • Slurs, dehumanizing language, or stereotyping directed at protected groups
  • Content promoting white supremacy, neo-Nazism, or any organized hate ideology
  • Creating or participating in communities whose primary purpose is to target, demean, or exclude individuals based on protected characteristics
  • Coded language, dog whistles, or symbols associated with hate movements

5.2 Violence and Threats

Users may not post, share, or promote content that:

  • Threatens, encourages, glorifies, or incites violence against any person or group
  • Depicts graphic violence intended to shock, disturb, or celebrate harm
  • Contains credible threats of physical harm, including indirect or veiled threats
  • Promotes or provides instruction for acts of terrorism or mass violence
  • Encourages self-harm or suicide

5.3 Doxxing and Privacy Violations

Users may not engage in doxxing or any unauthorized disclosure of another person's private information. This includes but is not limited to:

  • Sharing another person's home address, phone number, email address, or workplace without their explicit consent
  • Publishing government-issued identification numbers, financial information, or medical records
  • Posting photographs or recordings of individuals in private settings without their consent
  • Aggregating and publishing publicly available information with the intent to harass, intimidate, or enable others to target an individual
  • Encouraging or coordinating others to locate, contact, or confront an individual offline

5.4 Harassment and Bullying

Users may not engage in sustained, targeted harassment of any individual or group. Prohibited behaviors include:

  • Repeated unwanted contact, messages, mentions, or tags after being asked to stop
  • Coordinated campaigns to humiliate, shame, intimidate, or silence another user
  • Creating accounts or communities for the purpose of targeting a specific individual
  • Sexual harassment, including unwanted sexual advances, comments, or sharing of intimate content without consent
  • Brigading—organizing groups of users to mass-report, downvote, or flood another user's content

5.5 Misinformation and Manipulation

Users may not knowingly post or distribute false or misleading information that could cause harm, including:

  • Health misinformation that poses a direct risk to public safety
  • Deliberately fabricated content presented as fact (e.g., deepfakes used to deceive)
  • Coordinated inauthentic behavior, including use of bots, fake accounts, or sock puppets to manipulate discussions or artificially amplify content

5.6 Illegal Activity

Users may not use the Platform to facilitate, promote, or engage in any activity that violates applicable local, state, national, or international law. This includes but is not limited to the sale or distribution of illegal goods or services, fraud, money laundering, and exploitation of minors.

5.7 Spam and Commercial Abuse

Users may not engage in unsolicited commercial activity, including mass messaging, repetitive posting of promotional content, phishing, or the use of automated tools to generate or distribute content without prior authorization from Igsby.

5.8 Adult and Sexually Explicit Content

Users and Community Managers may not post, host, distribute, sell, or monetize adult or sexually explicit content or services anywhere on the Platform. This prohibition applies to every area of the Platform and to all forms of payment, including subscriber-only or paid content, memberships, tips, pay-per-view, digital goods, the social feed, profiles, and live or recorded media. Prohibited content and services include:

  • Content depicting explicit sexual acts, or that is intended primarily to cause sexual arousal
  • Pornography or sexually explicit images, audio, or video, including subscriber-only, paywalled, or tipped sexual content
  • Erotic art or imagery that depicts sexual acts or is intended primarily for sexual arousal, including when presented as fine art
  • Adult or sexually oriented services, including live audio or video sexual chat, webcam services, and escort or sexual services
  • Any monetization of the above through subscriptions, tips, pay-per-view, digital goods, or any other payment, whether processed on or off the Platform

This section does not prohibit non-sexual nudity in legitimate artistic, educational, documentary, or scientific contexts (for example, figurative fine art, life studies, or anatomical reference), provided the content is not sexually explicit, does not depict sexual acts, and is not intended primarily to cause sexual arousal. Igsby may require review of such content before it is published or monetized and retains sole discretion over what qualifies.

Content that violates this section will be removed and the responsible account may be demonetized, suspended, or terminated in accordance with Section 8.

6. Social Feed and User-Generated Content

6.1 Content on the Social Feed

The Igsby social feed allows users to post, share, and interact with content within their communities. All content posted to the social feed is subject to these Terms and the Prohibited Content and Conduct provisions outlined in Section 5. Igsby reserves the right to remove any content that violates these Terms, with or without prior notice. The visibility and reach of content may be reduced or restricted if it is flagged for potential policy violations pending review.

6.2 Content License Grant

Users retain full ownership of their original content. By posting content to the Platform, you grant Igsby a non-exclusive, royalty-free, worldwide, sublicensable license to display, distribute, reproduce, and promote that content solely in connection with operating and improving the Platform and Services.

6.3 License Duration and Termination

The license granted in Section 6.2 remains in effect for the duration of your account's existence on the Platform. Upon account deletion or termination:

  • The license terminates within 30 days of account deletion, except as described below
  • Content that has been shared, reposted, or embedded by other users may persist in those contexts after your account is deleted
  • Content required to be retained for legal, regulatory, or safety purposes may be retained beyond the 30-day period but will not be publicly displayed
  • Cached or archived copies may take up to 90 days to be fully purged from backup systems

Users may request deletion of specific content at any time through the Platform's content management tools, and such content will be removed within a commercially reasonable timeframe.

7. Community Moderation

7.1 The Role of Community Moderators

Igsby operates on a community-driven moderation model. Each community on the Platform may designate one or more moderators ("Mods") who are responsible for the day-to-day management and oversight of user interactions within their community. Moderators are expected to:

  • Actively monitor and review comments, posts, and other user-generated content within their community
  • Enforce these Terms and any supplemental community guidelines established for their specific community
  • Remove or flag content that violates Platform policies in a timely manner
  • Address user reports and complaints fairly and consistently
  • Maintain a welcoming and constructive environment for all community members

7.2 Moderator Agreement

Before assuming moderation privileges, each moderator must accept the Igsby Moderator Agreement, a supplemental set of terms that outlines their specific obligations, including:

  • Acknowledgment of and commitment to enforcing the Platform's Terms of Use and content policies
  • Agreement to respond to flagged content and user reports within the timeframes specified in the Moderator Agreement
  • Understanding that moderation privileges are granted at Igsby's discretion and may be revoked at any time for cause
  • Commitment to completing any required onboarding materials or training provided by Igsby
  • Agreement not to use moderation tools to advance personal interests, settle disputes, or retaliate against users

The Moderator Agreement is incorporated into these Terms by reference. Failure to comply with the Moderator Agreement constitutes a violation of these Terms.

7.3 Comment and Content Policing

Comments on the social feed and within community spaces are the primary responsibility of community moderators. Igsby provides moderators with tools to manage content, including the ability to:

  • Delete or hide individual comments or posts that violate community or Platform policies
  • Mute or temporarily restrict users who repeatedly violate guidelines
  • Ban users from their community for serious or repeated violations
  • Escalate issues to Igsby's Trust & Safety team when content poses a serious risk (e.g., credible threats, doxxing, illegal activity)

7.4 Moderator Accountability

Moderators are expected to act in good faith and in accordance with these Terms. Moderators must enforce their community's stated guidelines in a viewpoint-neutral manner, meaning moderation decisions must be based on published community rules and Platform policies—not on a moderator's personal agreement or disagreement with the viewpoint being expressed. Specifically, moderators may not:

  • Remove content or restrict users solely because the moderator personally disagrees with the opinion being expressed, provided the content does not violate Platform policies or the community's published guidelines
  • Use moderation privileges to settle personal disputes, favor certain users, or retaliate against users who have criticized or reported them
  • Engage in or permit the prohibited conduct described in Section 5 within their communities
  • Ignore or fail to act on reports of serious policy violations within a reasonable timeframe as defined in the Moderator Agreement

Igsby reserves the right to remove moderator privileges, suspend moderator accounts, or take over moderation of a community if a moderator is found to be in violation of these Terms, the Moderator Agreement, or is failing to uphold their responsibilities.

7.5 Igsby's Platform-Level Enforcement

While community moderators serve as the first line of defense, Igsby retains the right and responsibility to enforce these Terms at the platform level. This includes:

  • Proactively monitoring for egregious violations such as hate communities, coordinated doxxing, and illegal activity
  • Taking action on content or accounts that moderators have failed to address
  • Conducting periodic audits of communities to ensure compliance with Platform policies
  • Implementing automated detection systems to flag high-risk content for review

8. Enforcement and Consequences

Violations of these Terms may result in one or more of the following actions, at Igsby's sole discretion:

8.1 Content-Level Actions

  • Removal of individual posts, comments, or media
  • Reduction of content visibility or reach
  • Application of content warning labels

8.2 Account-Level Actions

  • Formal warning issued to the user's account
  • Temporary suspension of account access (duration determined by severity)
  • Permanent suspension (ban) of the user's account
  • Restriction of specific features (e.g., posting, commenting, creating communities)

8.3 Community-Level Actions

  • Quarantine of a community (restricting its visibility and discoverability)
  • Forced removal or replacement of community moderators
  • Permanent shutdown and removal of a community

8.4 Grounds for Immediate Suspension

The following violations are grounds for immediate and permanent account suspension without prior warning:

  • Creating or leading a community centered around hate, violence, or the targeting of individuals or protected groups
  • Doxxing or publishing another person's private information with malicious intent
  • Credible threats of physical violence or harm
  • Any content involving the exploitation of minors
  • Coordination of real-world violence or illegal activity
  • Repeated or egregious violations after prior warnings or suspensions

9. Reporting Violations

All users are encouraged to report content or conduct that they believe violates these Terms. Signed-in community members can use the in-app reporting tools on posts and comments. Concerns involving a profile, an entire community, or conduct that cannot be reported in-app may be sent to the Trust & Safety contact in Section 20. Authorized community moderators or Igsby personnel will review reports as appropriate. Users who submit reports in good faith will not face retaliation. However, abuse of reporting tools (for example, mass false reporting to harass another user) is itself a violation of these Terms.

10. Appeals Process

10.1 Right to Appeal

Users who believe an enforcement action was taken in error may submit an appeal within 30 days by emailing the Trust & Safety address in Section 20. The appeal should identify the account or content involved, the action being appealed, and any relevant context or evidence.

10.2 Standard Review

Appeals of content removals, warnings, temporary suspensions, and feature restrictions will be reviewed by an authorized person. When reasonably practicable, that person will not be the person who made the original decision. Igsby will make a reasonable effort to respond within 14 business days.

10.3 Review of Permanent Actions

Appeals involving permanent account suspensions or permanent community shutdowns receive an elevated review by Igsby. Igsby may request additional information and will make a reasonable effort to respond within 21 business days. The permanent action remains in effect while the appeal is reviewed unless Igsby states otherwise.

10.4 Finality

The decision rendered through the applicable appeals process is final. Users may not submit multiple appeals for the same enforcement action unless new material evidence is presented that was not available at the time of the original appeal.

11. Data Retention and Deletion

11.1 Active Accounts

While your account is active, Igsby retains all content you post, your account information, and associated metadata necessary to provide the Services.

11.2 Account Deletion by User

You may delete your account at any time through the Platform's account settings. Upon deletion:

  • Your profile, bio, and account information will be removed immediately
  • Your original posts and comments will be deleted or anonymized within 30 days
  • Content that other users have shared, quoted, or reposted may persist in those users' feeds in anonymized form (attributed to "Deleted User")
  • Backup copies may persist for up to 90 days before full purge

11.3 Account Suspension or Termination by Igsby

When Igsby suspends or terminates an account for policy violations:

  • Temporarily suspended accounts retain all data, which is restored upon reinstatement
  • Permanently suspended accounts will have public-facing content removed or anonymized within 30 days. Igsby may retain internal records of the account and its violations for safety, legal, and enforcement purposes

11.4 Community Deletion

When a community is shut down, whether by the community owner or by Igsby:

  • All community-specific content (posts, comments, media) will be archived for 30 days to allow members to export their own contributions, then permanently deleted
  • Members will be notified of the shutdown and provided instructions for data export where applicable

11.5 Legal Holds and Regulatory Retention

Igsby may retain data beyond the timelines described above when required by law, regulation, legal proceeding, or an active investigation. Such data will not be publicly displayed but may be disclosed to law enforcement or regulatory bodies as required.

12. Copyright Infringement and DMCA Policy

12.1 Respect for Intellectual Property

Igsby respects the intellectual property rights of others and expects its users to do the same. Users may not post, upload, or distribute content that infringes on the copyright, trademark, or other intellectual property rights of any third party.

12.2 DMCA Takedown Procedure

If you believe that content on the Platform infringes your copyright, you may submit a takedown notice to Igsby's designated DMCA agent. Your notice must include:

  • Identification of the copyrighted work you claim has been infringed
  • Identification of the material on the Platform that you claim is infringing, with sufficient detail to allow Igsby to locate it
  • Your contact information (name, address, telephone number, and email address)
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
  • Your physical or electronic signature

12.3 Designated DMCA Agent

DMCA takedown notices should be sent to Igsby LLC's DMCA Agent at dmca@igsby.com.

12.4 Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification to the DMCA agent. Counter-notifications must comply with the requirements of 17 U.S.C. § 512(g). Igsby will restore the removed content within 10–14 business days of receiving a valid counter-notification unless the original complainant files a court action.

12.5 Repeat Infringer Policy

Igsby will terminate the accounts of users who are determined to be repeat copyright infringers. A user will be considered a repeat infringer if they receive three or more valid DMCA takedown notices within any 12-month period.

13. Igsby Intellectual Property

All trademarks, logos, service marks, and branding associated with Igsby are the exclusive property of Igsby and may not be used without prior written permission. The Platform's design, code, features, and underlying technology are protected by intellectual property laws and may not be copied, modified, or reverse-engineered.

14. Disclaimers and Limitation of Liability

14.1 Disclaimer of Warranties

The Platform and Services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Igsby expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing, usage, or trade practice.

Without limiting the foregoing, Igsby does not warrant or represent that: (a) the Platform will be uninterrupted, timely, secure, or error-free; (b) the results obtained from using the Platform will be accurate or reliable; (c) any content, information, or materials available through the Platform will be free of viruses or other harmful components; or (d) any defects in the Platform will be corrected.

14.2 User-Generated Content Disclaimer

Igsby is not responsible for user-generated content and does not endorse, verify, or guarantee the accuracy of any opinions, advice, recommendations, or information posted by users, moderators, or community administrators. You acknowledge that your reliance on any content posted by other users is at your own risk.

14.3 Limitation of Liability

To the maximum extent permitted by applicable law, Igsby shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to damages resulting from: content posted by other users; loss of data, revenue, profits, or business opportunities; unauthorized access to or alteration of your account or content; or any conduct of third parties on the Platform.

To the maximum extent permitted by applicable law, Igsby's total aggregate liability to you for all claims arising out of or related to these Terms or your use of the Platform shall not exceed the greater of: (a) one hundred U.S. dollars ($100.00); or (b) the total amount you have paid to Igsby in the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based, including breach of contract, tort (including negligence), strict liability, or any other basis.

14.4 Force Majeure

Igsby shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond Igsby's reasonable control, including but not limited to: natural disasters, acts of God, pandemics, epidemics, government actions or orders, war, terrorism, riots, civil unrest, labor disputes, cyberattacks, distributed denial-of-service attacks, infrastructure failures, power outages, internet service disruptions, or failures of third-party service providers. During any such event, Igsby's obligations under these Terms shall be suspended for the duration of the event, and Igsby shall use commercially reasonable efforts to resume performance as soon as practicable.

15. Indemnification

You agree to indemnify, defend, and hold harmless Igsby and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. To the extent that any lawsuit or court proceeding is permitted under these Terms, you and Igsby agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.

16.2 Mandatory Arbitration

You and Igsby agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform (collectively, "Disputes") shall be resolved exclusively through final and binding arbitration, rather than in court, except as set forth in Section 16.5 (Small Claims Exception) below. Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. If the AAA is unavailable or unwilling to administer the arbitration, the parties shall agree on an alternative arbitration administrator, or a court of competent jurisdiction shall appoint one.

The arbitration shall be conducted by a single arbitrator in Maricopa County, Arizona, unless you and Igsby mutually agree to a different location. The arbitrator shall have exclusive authority to resolve all Disputes, including the scope, enforceability, and arbitrability of this arbitration agreement. The arbitrator's decision shall be final and binding, and judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

16.3 Arbitration Costs and Fees

Igsby shall pay all AAA filing fees, administration fees, and arbitrator fees for any arbitration initiated under this section, except for the initial consumer filing fee, which shall be your responsibility up to the amount set by the AAA's Consumer Arbitration Rules (currently $200). If the arbitrator finds that the substance of your claim or the relief sought is frivolous or brought for an improper purpose (as measured by the standards of Federal Rule of Civil Procedure 11(b)), then the payment of all arbitration fees shall be governed by the AAA Rules, and you agree to reimburse Igsby for any amounts previously paid on your behalf.

16.4 Class Action and Representative Action Waiver

You and Igsby agree that any Disputes shall be resolved on an individual basis only. To the fullest extent permitted by law, you and Igsby each waive the right to: (a) bring, join, or participate in any class action, collective action, representative action, or consolidated action in any court or arbitration forum; (b) act as a private attorney general or in any other representative capacity; or (c) participate in any class-wide or representative arbitration. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class, collective, or representative proceeding. If this class action waiver is found to be unenforceable with respect to a particular claim or request for relief, then that claim or request for relief shall be severed and proceed in a court of competent jurisdiction rather than in arbitration.

16.5 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court in Maricopa County, Arizona (or the county in which you reside), provided the claim falls within the jurisdictional limits of that court. If the claim is removed or transferred from small claims court for any reason, it shall be subject to the mandatory arbitration provisions of this section.

16.6 Opt-Out Right

You have the right to opt out of this arbitration agreement. To opt out, you must send written notice to Igsby's Trust & Safety team at trust@igsby.com within thirty (30) days of creating your account. Your notice must include your full name, your Igsby username, your email address associated with the account, and a clear statement that you wish to opt out of the arbitration agreement. If you timely opt out, you will not be bound by the arbitration provisions of this section, but all other provisions of these Terms will remain in effect. If you do not opt out within the 30-day period, you will be deemed to have agreed to this arbitration provision.

16.7 Survival

This arbitration agreement and class action waiver shall survive the termination of your account and the expiration or termination of these Terms.

17. Termination

You may terminate your account at any time by following the account deletion process within the Platform. Igsby may terminate or suspend your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections 5, 6.2, 6.3, 11, 12, 13, 14, 15, and 16 shall survive termination.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with the Moderator Agreement (where applicable), any supplemental community guidelines, and our Privacy Policy, constitute the entire agreement between you and Igsby regarding your use of the Platform and supersede all prior agreements and understandings.
